The Paradise Point Condominium Association, through its board of directors, has a duty to enforce its governing documents. The enforcement of the Declaration (CC & R’s), Bylaws and Rules and Regulations must be “in good faith”, not arbitrary or capricious, and by procedures which are fair and uniformly applied.
Articles of Incorporation
Articles of Incorporation initially create the corporation under state law and define the association’s basic purposes and powers. The Articles of Incorporation were filed with the State of Missouri on April 28, 2004.
Covenants, Conditions, and Restrictions
The Supplemental Declaration of Condominium is the Covenants, Conditions, and Restrictions (CC&Rs) that set up the guidelines for the operation of the Paradise Point Condominium Association as a non-profit corporation. It is a legally binding document that binds on all the Unit Owners at Paradise Point Condominium to the Association, establishes Association’s duties and responsibilities, and defines members' rights and obligations. The Bylaws are guidelines for the actual operation of Paradise Point Condominium Association. It defines the duties of the various offices of the Board of Directors, the terms of the Directors, the membership voting rights, required meetings and notices of meetings, and how the Bylaws may be amended.

The Rules and Regulations of Paradise Point Condominium Association is to protect the owner investments by providing a safe and enjoyable environment. They serve as a catch-all for the things that are not covered in the Supplemental Declaration or Bylaws. Often, these are the rules that may need revising over time due to changes at Paradise Point Resort.
